site located at the URL www.fastfind.com
(“www.fastfind.com”). By visiting, using and/or submitting
information to www.fastfind.com, you are accepting the practices described in
this Privacy Policy and the terms and conditions of FastFind’s Agreement
of Terms of Use located at the URL www.fastfind.com/Corporate/TermsOfUse.aspx
(the “Terms of Use”).
FastFind takes your privacy seriously, and has published this Privacy Policy to
explain how FastFind treats all information you may submit to www.fastfind.com,
except that information which is submitted pursuant to a sweepstakes entry.
Refer to the Official Rules and Privacy Policy for each individual sweepstakes
for FastFind's specific policies regarding information sharing and disclosure
pursuant to sweepstakes entry.
Collection of Personally Identifiable
Information
Some of the features of www.fastfind.com are
available to you without your providing personally identifiable information.
The following are certain situations in which FastFind may collect personally
identifiable information from you:

identifiable information, such as your name, address, telephone number, email
address, or social security number, to FastFind, its affiliates, or on
www.fastfind.com when you request to be matched with lenders, financial
institutions, and other service providers ("Requested Service
Providers"), FastFind may collect the information that you provide.
FastFind may also collect personally identifiable information that you provide
to supplement your requests or that you provide on any other forms or surveys
on www.fastfind.com.

Correspondence. If you send FastFind personal
correspondence, such as emails or letters, or if other users or third parties
send FastFind correspondence about your activities or postings on
www.fastfind.com, FastFind may choose to collect such information.

Business Partners and Affiliates. FastFind may receive and
retain your personally identifiable information from one of FastFind’s
business partners or affiliates.

Registration for Newsletters and Sweepstakes. FastFind
collects personally identifiable information from you if you register online
for one of FastFind’s newsletters and when you enter FastFind’s
sweepstakes. When you register online with FastFind, FastFind may ask for
personally identifiable information like your name, email address, birth date,
gender, ZIP code, occupation, industry, personal interests and other
demographic information.

information through FastFind’s chat rooms, blogs, podcasts, bulletin
boards or other forums (the “Forums”), FastFind will collect that
information you provide. FastFind retains this information as necessary
to resolve disputes, provide customer support and troubleshoot problems as
permitted by law and pursuant to FastFind’s Terms of Use.

advertising companies to serve advertisements when you visit www.fastfind.com.
These companies may use information (not including your name, address, email
address or telephone number) about your visits to www.fastfind.com and other
Web sites in order to provide advertisements about goods and services of

FastFind and its affiliates may use your
personally identifiable information to fulfill your requests for certain
products and services; contact you about offers, products and services; contact
you and deliver information to you that, in some cases, is targeted to your
interests, such as targeted advertisements, administrative notices, and
communications relevant to your use of www.fastfind.com; improve and customize
the advertising, content, layout, and services you see on www.fastfind.com;
improve marketing and promotional efforts; and analyze site usage.
Your personally identifiable information may
also be aggregated and used by FastFind and its affiliates for market research,
project planning, troubleshooting problems, detecting and protecting against
error, fraud or other criminal activity, to enforce FastFind’s Terms of

expressly agree to the use of your personally identifiable information
described in this Privacy Policy and to receive the information described
above. If you do not wish for FastFind to use your information or to
receive these communications, FastFind encourages you opt-out of the receipt of
certain communications, as set forth below.
If your personally
identifiable information is disclosed to a third party, such as a Requested
Service Provider, pursuant to this Privacy Policy, FastFind is not responsible
for such third party's use of such personally identifiable information or that
third party's privacy practices. A third party's privacy policies may
differ substantially from this Privacy Policy.
Disclosure of Personally Identifiable
Information
The following describes some of the ways
that your personally identifiable information may be disclosed:

Requested Service Providers.

Disclosure to Requested Service Providers. If you provide your
personally identifiable information to FastFind or its affiliates and request
to be matched with Requested Service Providers (e.g., by clicking "Click
Here to Get Your Free Quotes") (a "FastFind Request"), FastFind
may share, loan, rent or sell your personally identifiable information to
Requested Service Providers that FastFind matches with your FastFind Request or
to other third parties that may match you with a Requested Service Provider
(the "FastFind Service"). Disclosing your personally
identifiable information is necessary to provide you with the FastFind
Service. If you make a FastFind Request, you expressly consent to the
disclosure of your personally identifiable information. If you do not
want your personally identifiable information shared with Requested Service
Providers or third parties that may match you with Requested Service Providers,
then you should not submit a FastFind Request.
YOU MAY RECEIVE TELEMARKETING CALLS AS A
CONSEQUENCE OF SUBMITTING YOUR TELEPHONE NUMBER TO FASTFIND, EVEN IF YOU ARE ON
THE NATIONAL DO NOT CALL REGISTRY OR ANY OTHER DO NOT CALL REGISTRY.
FASTFIND ESTIMATES THAT YOU MAY RECEIVE TELEPHONE CALLS FROM A MAXIMUM OF FOUR
(4) REQUESTED SERVICE PROVIDERS IF YOU PROVIDE FASTFIND WITH YOUR TELEPHONE
NUMBER.

Disclosure in Connection with the FastFind Service. If you are
matched with Requested Service Providers, you expressly consent to FastFind's,
its affiliates' and the Requested Service Providers' disclosure, sharing and
use of any personally identifiable information provided by you in connection
with your FastFind™ Request and providing you the FastFind™
Service. If you do not want FastFind, its affiliates and Requested
Service Providers to disclose, share and use your personally identifiable
information in connection with your FastFind Request and the FastFind Service,
then do not submit your personally identifiable information to FastFind or its
affiliates.

Disclosure in Connection with Research for Your FastFind Request.
If you are matched with Requested Service Providers, you expressly consent to
the Requested Service Providers conducting any research necessary to provide
you with quotes for your FastFind Request. Requested Service
Providers may need to share your personally identifiable information to conduct
such research. If you do not want Requested Service Providers to
conduct necessary research to provide you with a quote for your FastFind
Request, then do not submit your personally identifiable information to
FastFind or its affiliates.

External Service Providers. There are a number of
separate services offered by third parties, including, without limitation,
FastFind’s affiliates and Requested Service Providers, that FastFind
refers to as external service providers that may be complementary to your use
of www.fastfind.com. If you choose to use these separate services,
disclose information to the external service providers, and/or grant them
permission to collect information about you, then their use of your information
is governed by their privacy policy. FastFind does not disclose your
personally identifiable information to external service providers other than as
set forth in this Privacy Policy or unless you provide your explicit
consent. With your consent, FastFind may provide some of your personal
information to the external service provider offering such services, for your
convenience. To prevent FastFind’s disclosure of your personally
identifiable information to an external service provider, you can decline such
consent or simply not use their services. You should evaluate the
practices of external services providers before deciding to use their services.

Internal Service Providers. FastFind may use third
parties that FastFind refers to as internal service providers to facilitate or
outsource one or more aspects of FastFind’s business, product and service
operations that FastFind provides to you (e.g., technology, analytical tools,
and advertising campaign management) and therefore FastFind may provide some of
your personal information directly to these internal service providers.
Except for third-party advertisers which are described below, these internal
service providers are subject to confidentiality agreements with FastFind or
other legal restrictions that prohibit their use of the information FastFind
provides them for any other purpose except to facilitate the specific
outsourced FastFind related operation, unless you have explicitly agreed or
given your prior permission to them for additional uses. In some
instances, the internal service provider may collect information directly from
you. If you provide additional information to an
internal service provider directly, then their use of your personally
identifiable information is governed by their applicable privacy policy.

Third- Party Advertisers. FastFind may use third-party advertising
companies to serve advertisements to you when you visit www.fastfind.com.
FastFind may disclose information about your visits to www.fastfind.com to
third-party advertising companies to market more effectively to you.
FastFind's third-party advertising company may link your personally
identifiable information, such as your name, address and e-mail address, to
other information which they collect, such as past purchase information and
your future Web usage from other sites. By providing your personal
information on www.fastfind.com, some of your future Web usage will no longer
be anonymous to FastFind's third-party advertising company. It is
possible that FastFind's third-party advertising company may also link your
name, address and e-mail address to your past Web usage. If this occurs,
some of your past Web activity will also no longer be anonymous to the
advertising company.

Other Advertisers. In addition to the disclosure to
FastFind's third-party advertising company, as stated above, FastFind may
aggregate personally identifiable information and disclose such information in
a non-personally identifiable manner to advertisers and other third parties
that are not FastFind service providers for marketing and promotional
purposes. However, in these situations, FastFind does not disclose to
these entities any information that could be used to identify you
personally. Certain information, such as your name, email address,
password, social security number, credit card number, and bank account number,
are not disclosed to these third parties in a personally identifiable manner
without your explicit consent.
Notwithstanding the foregoing, FastFind
reserves the right (and you authorize FastFind) to share or disclose your
personally identifiable information when FastFind determines, in its sole
discretion, that the disclosure of your personally identifiable information is
necessary to identify, contact, or bring legal action against you if:

you are or may be violating this Privacy Policy or FastFind’s Terms of
Use;

you are interfering with another's rights or property, including, without
limitation, FastFind's rights or property;

you are violating any applicable law, rule or regulation;

necessary or required by any applicable law, rule or regulation; and/or

requested by authorities in the event of any act of terrorism or instance of
local, regional or national emergency.
Personally identifiable information and
other personal information collected from you may also be transferred to a
third party as a result of a sale, acquisition, merger, reorganization, other
transfer or bankruptcy (a “Transfer”) involving FastFind and/or its
affiliates. FastFind and its affiliates specifically reserve the right to
transfer personally identifiable information collected from or in connection
with www.fastfind.com, and any of its databases, together with any personally
identifiable information contained therein, to a third party in connection with
a Transfer, and nothing in this Privacy Policy is intended to interfere with
the ability of FastFind to transfer all or part of its business and/or assets
(including www.fastfind.com) to an affiliate or independent third party at any
time, for any purpose, without any limitation whatsoever.
In addition, due to the existing regulatory
environment, FastFind cannot ensure that all of your private communications and
other personally identifiable information will never be disclosed in ways not
otherwise described in this Privacy Policy. By way of example (without
limiting the foregoing), FastFind may be forced to disclose personal
information to the government or third parties under certain circumstances or
third parties may unlawfully intercept or access databases, transmissions or
private communications. Therefore, although FastFind values your privacy
and uses industry standard practices to protect your privacy, FastFind does not
promise, and you should not expect, that your personally identifiable
information or private communications will always remain private.
If FastFind becomes aware that your
personally identifiable information, including your social security number, has
been unlawfully intercepted or accessed, FastFind will provide you with notice
of such unlawful access by sending you an email or posting a notice on
www.fastfind.com, or as otherwise required by law.
NOTE: If you are submitting personally
identifiable information pursuant to sweepstakes entry, FastFind reserves the
right to share, loan, rent and/or sell the personally identifiable information
that you submit with its affiliates and other third parties. Please refer to
the Official Rules and Privacy Policy for each individual sweepstakes for the
specific guidelines regarding information sharing and disclosure.
Changes to Personally Identifiable
Information and Use Preferences
You may at any time request a copy of FastFind’s record of your
personally identifiable information, change your personally identifiable
information or use preferences, or opt-out of FastFind's use of your personally
identifiable information by submitting an online
Opt-Out Request Form.
Please note that opt-out requests do not
apply to the disclosure of personal information that you have disclosed during
a FastFind™ Request. This means that, once you submit a
FastFind™ Request, you may not opt-out of the disclosure of personally
identifiable information in connection with that FastFind™ Request, and
that you may receive communications from FastFind and Requested Service
Providers in connection with that FastFind™ Request after the time of
your opt-out request.
Newsletters and CAN-SPAM Compliance
FastFind sends only verified, double-opt-in email newsletters, specifically
requested by FastFind subscribers. Subscriptions to FastFind.com newsletters
are verified by sending an email confirmation to your email address, which
requires a positive response before an email address is added to
FastFind’s list. FastFind.com is fully compliant with the Controlling the
Assault of Non-Solicited Pornography and Marketing Act of 2003 (the
"CAN-SPAM Act"). FastFind is not responsible for any email
communications that you may receive from third parties, including, without
limitation, Requested Service Providers.
Cookie technology
"Cookies" are alphanumeric
identifiers in the form of text files that are inserted and stored by your web
browser on your computer's hard drive. FastFind and its affiliates may set and
access cookies on your computer to track and store preferential information
about you. FastFind and its affiliates may gather information about users
through cookie technology and may disclose such information as set forth in
this Privacy Policy.
Web beacons
”Web beacons”, also called
single-pixels (1x1) or clear GIFs, are electronic images that allow a website
to access cookies and help track marketing campaigns and general usage patterns
of visitors to those websites. Web beacons can recognize certain types of
information, such as cookie numbers, time and date of a page view, and a
description of the page where the Web beacon is placed. No personally
identifiable information about you is shared with third parties through the use
of web beacons.

Internal use of web beacons. FastFind may use web
beacons internally to count users and recognize users through cookies.
Access to cookies helps FastFind personalize your experience when you visit
FastFind.com.

Email. FastFind may include web beacons in
HTML-formatted email messages that FastFind or its affiliates or agents
send. Including web beacons in email messages helps FastFind determine
your interest in and the effectiveness of such emails.

information about FastFind.com users, such as demographic and usage
information, to its partners and other third parties. FastFind may also

Security
Personally identifiable information you
submit to FastFind is password-protected for your privacy and security.
FastFind participates in the Thawte™ certification program to verify
FastFind's server's security. In certain areas FastFind uses
industry-standard SSL-encryption to protect data transmissions. In the event
that an unauthorized third party compromises FastFind security measures,
FastFind will not be responsible for any damages directly or indirectly caused
by an unauthorized third party's ability to view, use or disseminate such
information.
Links to Other Web sites
www.fastfind.com may include links to other third party Web sites. Such links
are not an endorsement by FastFind of those Web sites and/or the products or
services offered there. Third party Web sites may have different privacy
policies and FastFind is not responsible for the privacy practices of those
third party Web sites. If you click on a link to a third party Web site,
FastFind encourages you to check the privacy policy of that Web site, as it may
differ substantially from that of this Privacy Policy.
Access and Use of www.fastfind.com
www.fastfind.com is intended to be accessed
and used only by adults and is not directed to children under the age of 18.
FastFind does not knowingly permit registration or submission of personally
identifiable information by anyone under the age of 18.
Changes to this Privacy Policy
FastFind reserves the right to update, amend
and/or change this Privacy Policy at any time in its sole discretion and
without notice. Updates to this Privacy Policy will be posted here. Any
information FastFind collects from you online is subject only to
FastFind’s most current Privacy Policy. You are encouraged to revisit
this Privacy Policy from time to time in order to review any changes that have
been made. FastFind’s last update was December 1, 2007. You continued
access and use of www.fastfind.com following the posting of any such changes
shall automatically be deemed your acceptance of the same.

Governing Law; Arbitration
This Privacy Policy is to be governed by and
construed in accordance with the internal laws of the State of Florida, without
regard for principles of conflicts of laws. Any civil action, claim, dispute or
proceeding arising out of, or relating to, this Privacy Policy shall be
referred to final and binding arbitration, before a single arbitrator, under
the commercial arbitration rules of the American Arbitration Association in
Palm Beach County, Florida. You and FastFind shall select the arbitrator, and
if you and FastFind are unable to reach agreement on selection of the
arbitrator within thirty (30) days after the notice of arbitration is served,
then the American Arbitration Association shall select the arbitrator.
Arbitration shall not commence until the party requesting it has deposited One
Thousand Dollars ($1,000.00) with the arbitrator as a retainer for the
arbitrator's fees and costs. The party requesting arbitration shall advance
such sums as are required from time to time by the arbitrator to pay the
arbitrator's fees and costs until the prevailing party is determined or the
parties have agreed in writing to an alternate allocation of fees and costs.
Judgment upon any award rendered by the
arbitrator shall be final, binding and conclusive upon you and FastFind, and
your and FastFind's respective administrators, executors, legal
representatives, successors and assigns, and may be entered in any court of
competent jurisdiction. Notwithstanding the previous sentence, in no event
shall either you or FastFind be entitled to punitive, special, indirect or
consequential damages, and both you and FastFind hereby waive your rights to
any punitive, special, indirect or consequential damages, including, but not
limited to, damages for any loss of profit, revenue or business. You
agree that, subject to the previous sentence, such an award by the arbitrator
shall be your sole and exclusive remedy pursuant to this Privacy Policy.
Miscellaneous
If any portion of this Privacy Policy is deemed unlawful, void or unenforceable
by any arbitrator, this Privacy Policy as a whole shall not be deemed unlawful,
void or unenforceable, but only that portion of this Privacy Policy that is
unlawful, void or unenforceable shall be stricken from this Privacy Policy. The
headings contained in this Privacy Policy are for convenience of reference
only, are not to be considered a part of this Privacy Policy, and shall not
limit or otherwise affect in any way the meaning or interpretation of this
Privacy Policy.
All covenants, agreements, representations and warranties made in this Privacy
Policy, as may be amended by FastFind from time to time, shall survive your
acceptance of this Privacy Policy.
This Privacy Policy and the Terms of Use
represent the entire understanding and agreement between you and FastFind
regarding the subject matter of the same, and supersede all other previous
agreements, understandings and/or representations regarding the same.
